In compliance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD), we inform you that the personal data provided through this website will be processed by:

2. Information collected automatically

When you visit our website, we automatically collect certain technical information through cookies and similar technologies, including: IP address, browser type and operating system, date and time of the visit, pages visited and time spent on them, and the URL from which you accessed our website. This information is used for the proper functioning of the site, usage analysis and improving the user experience. Analytics and advertising cookies are only activated after the user's consent (see section 11).

3. Purpose of data processing

The data provided by users may be used for the following purposes:

  • Managing requests for information, contact or appointment booking.
  • Sending commercial communications related to our advertising and marketing services, if authorised by the user.

Users who expressly tick the consent box for commercial communications authorise Desorbitante to contact them via WhatsApp Business, email, telephone and SMS in order to respond to requests for information about our services and to send commercial communications, proposals, news and updates.

WhatsApp communications are carried out through the WhatsApp Business Platform, operated by Meta Platforms Inc., which may process the data in accordance with its own privacy policy.

The user may revoke this consent at any time by:

  • Replying "BAJA" (unsubscribe) to any message received.
  • Requesting it during any phone call.
  • Writing to info@desorbitante.com

Retention period: until the user revokes their consent or expressly requests to unsubscribe.

4. Legal basis for processing

Data processing is based on:

  • The user's express consent.
  • The performance of a contract or the application of pre-contractual measures.
  • Compliance with applicable legal obligations.
  • The controller's legitimate interest in the security and proper functioning of the site.

5. Data retention

Data will be kept for the time necessary to fulfil the purpose for which it was collected and, at a minimum, for the following statutory periods:

  • Contact and lead data: until the user revokes their consent.
  • Contractual and billing data: 6 years (article 30 of the Spanish Commercial Code).
  • Data for the defence of claims: 5 years (article 1964 of the Spanish Civil Code).
  • Tax data: 4 years (Spanish General Tax Law).

6. Data disclosures and transfers

Data will not be disclosed to third parties, except where legally required or where necessary for the proper provision of the service.

Some technology providers that process data on our behalf (such as Google LLC, Meta Platforms Inc., HighLevel Inc. and Cloudflare, Inc.) are located in the United States. Such transfers are carried out under the EU-U.S. Data Privacy Framework (European Commission adequacy decision of July 2023) or, failing that, under the Standard Contractual Clauses approved by the European Commission pursuant to article 46 of the GDPR.

7. User rights

Users may exercise their rights of:

  • Access to their data.
  • Rectification of inaccurate data.
  • Erasure when the data is no longer necessary.
  • Objection to the processing of their data.
  • Restriction of processing in certain circumstances.
  • Portability of their data in electronic format.

To exercise these rights, you may send a request together with a copy of your ID document to the postal address indicated above or to the email address info@desorbitante.com.

Users also have the right to file a complaint with the Spanish Data Protection Agency (AEPD) if they consider that data protection regulations have been breached.

DESORBITANTE SL will respond to the request within a maximum of one (1) month from receipt, a period which may be extended by a further two months in particularly complex cases, subject to prior notice to the data subject.

8. Children's privacy

Our website and services are aimed exclusively at people over 18 years of age. We do not knowingly collect personal data from minors. If we detect that a minor has provided their data through our forms, we will delete that information immediately. If you become aware that a minor has provided their data through this site, please let us know at info@desorbitante.com.

9. Data security

DESORBITANTE SL has adopted the technical and organisational measures necessary to guarantee the security of personal data and prevent its alteration, loss, unauthorised processing or access, in accordance with article 32 of the GDPR. These measures include encryption of data in transit (SSL/TLS), restricted access control to systems, confidentiality agreements with staff, regular backups and periodic review of security procedures. However, no data transmission or storage system can be guaranteed to be completely secure.

10. Providers and sub-processors

For the provision of our services, DESORBITANTE SL uses technology providers that may access personal data as data processors. These include:

  • Google LLC (analytics and advertising).
  • Meta Platforms Inc. (advertising and messaging).
  • HighLevel Inc. (CRM and appointment booking system).
  • Cloudflare, Inc. (site hosting and content delivery network).
  • Marketing automation tools.

All of them offer sufficient guarantees in accordance with article 28 of the GDPR.

11. Tracking technologies

We use cookies and similar technologies (pixels, web beacons) for the operation of the site, usage analysis and personalisation of the experience. Cookies fall into the following categories:
